When we use the words "we," "us," and "our," we're talking about Kesvara. We operate this website and store, along with all the information, content, features, tools, products, and services you'll find here, to make sure you have a wonderful shopping experience (what we call the "Services"). Shopify powers Kesvara, allowing us to deliver these Services to you.

When You Place an Order
Placing an order means you're offering to buy from us. Kesvara can choose to accept or decline your order for any reason we see fit. Your order doesn't count as accepted until Kesvara confirms it. We need to receive and process your payment before we accept your order. Please double-check your order before you submit it—Kesvara might not be able to cancel orders after we've accepted them. If we decide not to accept your order, make changes to it, or cancel it, we'll try to reach you using the email address, mailing address, and phone number you gave us when you ordered.

You're telling us that your purchases are for your own personal use or your household, and not for reselling or exporting for business purposes.

Understanding Prices and How We Bill You
Prices, discounts, and special offers can change without us letting you know ahead of time. The amount you'll pay is whatever price is active when you place your order, and this will be shown in your order confirmation email. Unless we say something different, prices listed on our site don't include taxes, shipping, handling fees, customs, or import charges.
The prices on our website might differ from what you'd see in our physical locations or in other online stores run by third parties. We sometimes run special promotions on our Services that have their own separate terms and conditions. If there's a conflict between promotion terms and these Terms, the promotion terms win.

We're not responsible if shipping takes longer than expected. Delivery timeframes we give you are just estimates and aren't guaranteed. We can't be held responsible for delays caused by shipping companies, customs, or things we can't control. Once your products go to the shipping carrier, they're yours—we're not responsible for them anymore.

Our Intellectual Property Rights
Everything in our Services—including all our names, brands, words, layouts, images, graphics, product reviews, videos, sounds, and how it's all organized—belongs to Kesvara, our partners, or people who've given us permission to use their work. It's all protected by patents, copyrights, and other intellectual property laws in the U.S. and around the world.

You can't copy, share, change, create new versions of, display, perform, republish, download, save, or send any of our material without asking us in writing first. Except for what these Terms specifically allow, nothing here gives you permission to use any patents, brand names, copyrights, or other intellectual property belonging to Kesvara, Shopify, or anyone else. Using our Services in ways we don't permit could break federal and state intellectual property laws. We keep every right we haven't specifically given to you.
Kesvara's name, logo, product names, service names, designs, and taglines are our trademarks or belong to our partners and licensors. You can't use these without our written permission. Shopify's name, logo, product and service names, designs, and taglines are Shopify's trademarks. Everything else on our Services belongs to whoever owns it.

Tools We Might Offer
We might give you access to tools made by third parties as part of our Services. We don't monitor these tools, and we don't have any say in how they work or what they do.

How Shopify Works With Us

You're also confirming that your Feedback won't contain anything illegal, mean, obscene, or harmful, and it won't have computer viruses or anything else that could hurt our Services or any related website. You can't use a fake email, pretend to be someone else, or mislead us in any way with your Feedback. You're responsible for everything in your Feedback and whether it's accurate. We're not responsible for anyone's Feedback, including yours or anyone else's.

Typos, Mistakes, and Missing Information

You can't access or use our Services, directly or indirectly, for: (a) anything unlawful or with bad intentions, (b) breaking any international, federal, state, provincial, or local laws or rules, (c) stealing or violating our intellectual property rights or anyone else's, (d) being mean to or hurting any of our team members or other people, (e) spreading false or misleading information, (f) sending, getting, uploading, downloading, using, or reusing material that doesn't follow these Terms, (g) sending advertising, promotions, junk mail, spam, or anything like that, (h) pretending to be someone you're not or trying to, or (i) doing anything else that stops people from using our Services or could hurt Kesvara, Shopify, or our users.
You also agree you won't: (a) put viruses or other harmful code on our Services, (b) copy or resell parts of our Services, (c) gather personal information about other people, (d) spam or trick people on the Services, (e) use robots, spiders, scraping tools, data collection tools, AI tools (like agentic AI), or other automatic or manual ways to access our Services, or (f) break through, go around, or bypass any security or permission systems we use to protect our Services. We can shut down, disable, or cancel your account anytime if we think you've broken any part of these Terms, and we don't have to give you notice first.

Information About Agents
14.1 These "Agent Terms" apply if you use, turn on, or set up an Agent to access, use, or interact with our Services. "Agent" means any software or service that does things on its own or semi-automatically on your behalf or at your request and can run on your device without someone actively controlling it.
14.2 Any Agent needs to identify itself and follow what we ask in section 14.4 below in order to use our Services. Also, if we tell an Agent to stop accessing our Services, it has to listen.
14.3 We can limit how any Agent accesses our Services, including by using technology to control it.
14.4 Agents must: (i) tell us in all their web requests that they're an Agent and give us their name by putting "Agent/[agent name]" in the user agent part of the request, (ii) not hide that they're an Agent, like by acting like a human or solving CAPTCHAs, (iii) answer honestly if we ask whether interactions are coming from a person or a computer, (iv) not try to get around or bypass anything we use to block, limit, or control how Agents use our Services.

When We Can End This Agreement
We can stop this agreement or your access to our Services (or part of them) anytime we choose, without notice. You'll still be responsible for everything you owe us up until the end date.

We Don't Make Promises About the Services
We're sharing the information on our Services just for general knowledge. We can't guarantee it's accurate, complete, or useful. Anything you rely on from us is your own risk. We're not responsible if you or anyone else relies on anything we've shared, or if someone learns about it from someone else.
EXCEPT FOR WHAT Kesvara SPECIFICALLY SAYS, OUR SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY PROMISES, GUARANTEES, OR CONDITIONS—EXPRESS OR IMPLIED. THIS INCLUDES ALL IMPLIED PROMISES ABOUT SALES VALUE, QUALITY, WHETHER THINGS WORK AS INTENDED, WHETHER THEY'LL LAST, WHO OWNS THEM, AND THAT THEY DON'T VIOLATE ANYONE'S RIGHTS. WE DON'T GUARANTEE THAT USING OUR SERVICES WILL BE SMOOTH, HAPPEN QUICKLY, BE SAFE, OR NOT HAVE ERRORS. SOME PLACES DON'T ALLOW THESE KINDS OF DISCLAIMERS, SO THIS MIGHT NOT APPLY TO YOU.

We're Not Responsible for Most Damages
TO THE EXTENT THE LAW ALLOWS, Kesvara AND OUR TEAM, PARTNERS, DIRECTORS, OFFICERS, WORKERS, PARTNERS, AGENTS, CONTRACTORS, PROVIDERS, AND LICENSORS—AS WELL AS SHOPIFY AND ITS PARTNERS—AREN'T RESPONSIBLE FOR ANY HURT, LOSS, OR DAMAGES THAT ARE DIRECT, INDIRECT, UNEXPECTED, PUNITIVE, SPECIAL, OR AS A RESULT OF SOMETHING ELSE, INCLUDING LOST PROFITS, LOST INCOME, LOST SAVINGS, LOST DATA, REPLACEMENT COSTS, OR ANYTHING SIMILAR. THIS APPLIES WHETHER IT'S FROM A CONTRACT, SOMEONE'S FAULT (INCLUDING CARELESSNESS), STRICT LIABILITY, OR ANY OTHER REASON. THIS INCLUDES ANYTHING FROM USING OUR SERVICES OR ANYTHING YOU BUY USING THEM, OR ANY OTHER CLAIM TIED TO HOW YOU USE OUR SERVICES OR ANYTHING YOU GET FROM US, INCLUDING MISTAKES, LOSSES, OR DAMAGES FROM USING WHAT WE'VE SHARED—EVEN IF WE KNEW IT COULD HAPPEN.

You'll Protect Us From Problems
You're agreeing to keep Kesvara, Shopify, and our team, partners, directors, officers, workers, agents, contractors, and service providers safe from any losses, damages, costs, or claims—including lawyer fees—that anyone else might ask for because: (1) you broke these Terms or something they mention, (2) you broke any law or someone else's rights, or (3) how you use our Services.
We'll let you know if there's a claim we need protection from, though if we don't tell you right away, that doesn't get you out of your responsibility unless you're really hurt by the delay. We can manage how that claim gets defended and settled on your dime, even choosing the lawyers, but we won't agree to something that requires you to do something without your okay (and you can't say no unfairly). You'll help us defend the claim by sharing whatever information we need.

If Part of These Terms is Illegal
If any part of these Terms gets ruled illegal or unenforceable, that part will still be enforced as much as possible, and we'll remove just that part. This won't affect the rest of these Terms, which are still good and will be enforced.

We Don't Waive Our Rights and This is Our Whole Agreement
If we don't enforce or use any right or part of these Terms, that doesn't mean we're giving it up.
These Terms of Service, along with any policies or guidelines we post on this website or talk about with respect to our Services, are everything between us and describe how you use what we offer. They replace any earlier agreements, talks, or proposals between us—whether spoken or written. This includes any older versions of these Terms.
We won't read these Terms in a way that goes against the person who wrote them.

You Can't Move This Agreement to Someone Else
You can't hand off, move, or assign this agreement or what you're responsible for without asking us in writing first, and if you try, it won't count. We can move this agreement or what we're responsible for whenever we want, without asking you or letting you know first.

What Laws Apply Here
These Terms of Service and any other agreements about our Services are controlled by and explained using the laws of the federal government and the state or territory where Kesvara is based. You and Kesvara both accept that we can be sued in those courts and that they have the power to decide cases involving us.

We have the right to update, change, or modify any part of these Terms anytime by posting the new version on our website. You should check back regularly to see if anything's different. If there are big changes, we'll let you know the way the law requires, and those changes will start on the date we say in that notice. When you keep using our Services after we make changes, that means you're accepting them.
